Terms of Service

Part 1 – GENERAL

1.1 The website BadBit.Games is operated by Lifeblood Gaming SRL, a company incorporated in the Curridabat district of San José, Costa Rica (“Company”) and all game content (“the Games”) is the property of the Company.

1.2 These Terms of Service (“ToS”) apply to the usage of the Games through BadBit.Games (“Website”) through related enabling internet, mobile or other platforms by you (“You” or “the Player”).

1.3 These ToS constitute a binding agreement between You and BadBit.Games.

1.4 These ToS come into force as soon as you click on the “ACCEPT” button, by doing so You signify to BadBit.Games that You have read these ToS and accept them. By using any functions, features or parts of the Website You signify that You agree with these ToS.

1.5 You must read these ToS carefully in their entirety before clicking on the “I accept” button. If You do not agree with any provision of these ToS You must not use or continue to use the Website.

1.6 You fully understand and agree to be bound by the terms and conditions contained herein and as may be amended by the Company from time to time.

1.7 BadBit.Games reserves the right to modify and amend this Agreement at any time with or without notice.

1.8 Rules and explanations in respect to the games provided separately on the Website are incorporated into these ToS by reference.

1.9 Players from certain jurisdictions might from time to time be excluded from playing the games offered on the Website, such exclusions may be applied by the Company at any time with or without advance notice.

Part 2 – ELIGIBILITY TO USE BADBIT.GAMES’ SERVICES:

2.1 You may participate in any of the Games if and only if You are over eighteen (18) years of age or such higher minimum legal age of majority as stipulated in the jurisdiction of Your residence; and (B) It is legal for You to participate in the Games according to applicable laws in the jurisdiction of your residence.

2.2 It is entirely and solely Your responsibility to enquire and ensure that You do not breach laws applicable to You by participating in the Games.

2.3 BadBit.Games reserves the right to refuse any Ethereum or Loom Network address from playing the Games. However all contractual obligations already made shall be honoured.

2.4 BadBit.Games prohibits player collusion and do not allow any kind of robots and programmed devices to participate in game play. BadBit.Games reserves the right to void any game play which results from the use of robots and/or programmed devices.

2.5 Upon requesting a self-exclusion, BadBit.Games will immediately ban that Ethereum address and the associated Loom Network address and prevent the Player to play on that particular address. It’s the Player’s responsibility to notify BadBit.Games of any other addresses the Player might have and promise not to open any other accounts. BadBit.Games will make reasonable efforts to try to prevent the use of new addresses but it’s the Player’s sole responsibility to make sure no other addresses are created. BadBit.Games cannot be held accountable for potential losses on other addresses.

Part 3 – DEPOSITS AND WITHDRAWALS

3.1 All Games offered at BadBit.Games are run by trustless smart contracts deployed on the Ethereum and/or Loom Network public blockchains. As such Players do not deposit their cryptocurrencies with BadBit.Games. Players’ winnings are initially stored as Players’ contract balance but ownership of these funds remains solely with the Players. BadBit.Games is programmatically prevented from moving any Players’ contract balance. As a result of the technologies and procedures described above, and due to the irreversible nature of cryptocurrency transactions, Players are reminded that it is their sole responsibility to ensure sufficient care is taken in performing any cryptocurrency transaction. BadBit.Games cannot be held responsible for any funds transferred to the wrong address, which will be lost forever.

3.2 BadBit.Games will never request Players to send cryptocurrencies or fiat currencies to any address under the control of BadBit.Games.

3.3 BadBit.Games will not grant any form of virtual credit whatsoever for participation in any of the Games.

3.4 BadBit.Games can, under certain circumstances, credit a Player’s account with so-called “bonus balance”. The conditions for the crediting of the bonus and the amount of the bonus is determined by BadBit.Games and set out on the Website or at the various social media channels of BadBit.Games from time to time. Any bonus balance remains the property of BadBit.Games and cannot be withdrawn to Players’ contract balance or to Players’ cryptocurrency wallets. Bonus balance can be wagered on qualifying bets and, upon winning once, will be converted to contract balance which is available for Players to withdraw.

3.5 BadBit.Games is not a financial institution and thus should not be treated as one. Your balances, including Wallet Ether, Loom Ether, Contract Ether and Bonus Ether, will not bear any interest.

3.6 We reserve the right to use additional procedures and means to verify your identity. These “Know Your Client” (KYC) or “Customer Due Diligence” (CDD) procedures could include (but are not limited to) a selfie with a document or form of identification.

3.7 It is the responsibility of the Player to ensure that all documents as a part of the KYC/CDD process are genuine. Fake or fraudulent documents provided will result in ban of the offending Ethereum and Loom Network address and BadBit.Games will refuse future service to the Player.

3.8 BadBit.Games is not an exchange and therefore does not execute any conversion between any cryptocurrencies, between any fiat currencies, or between any crypto and fiat currency pairs.

3.9 During our KYC/CDD procedures, we reserve the right to request a telephone number to which we will make a phone call to verify Players’ identities.

3.10 Withdrawal from Contract Ether to Loom Ether is a transaction processed by the Loom Network. Withdrawal from Loom Ether to Player’s Ethereum Wallets is a transaction processed by the Ethereum network. Because these are not transactions processed by BadBit.Games, we have no control over the success or failure of these transactions or the time it takes for funds to get to their intended destinations. Players are encouraged to check the status of their withdrawal transactions on publicly available Ethereum network services such as etherscan.io and publicly available Loom Network services such as The Basechain block explorer.

3.11 If BadBit.Games mistakenly credits your Ethereum address, Loom Network address or your contract balance with winnings that do not belong to You, whether due to a technical error, error in the pay-tables, or human error or otherwise, the amount will remain the property of BadBit.Games. If You have withdrawn funds that do not belong to You prior to us becoming aware of the error, the mistakenly paid amount will (without prejudice to other remedies and actions that may be available at law) constitute a debt owed by You to us. BadBit.Games will attempt to contact the Player in such circumstances, using all available means, to request the repayment of such mistakenly deposited funds, which the Player shall be obliged to return.

3.12 The Player is fully responsible for paying all fees and taxes applied to their winnings according to the laws of the jurisdiction of the Player’s residence.

Part 4 – YOUR OBLIGATIONS AS A PLAYER:

4.1 You hereby declare and warrant that:

(A) You are over 18 years of age or such higher minimum legal age of majority as stipulated if the jurisdiction of Your residence (e.g. Estonia – 21 years) and, under the laws applicable to You, legally allowed to participate in the Games offered on the Website;

(B) You participate in the Games strictly in Your personal non-professional capacity for recreational and entertainment reasons only;

(C) You participate in the Games on Your own behalf and not on behalf of any other person;

(D) All information that You provide to BadBit.Games during the term of validity of this agreement is true, complete, and correct, and that You shall immediately notify BadBit.Games of any change of such information;

(E) You are solely responsible for reporting and accounting for any taxes applicable to You under relevant laws for any winnings that You receive from playing the Games at BadBit.Games;

(F) You understand that by participating in the Games you take the risk of losing your cryptocurrencies;

(G) You shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to Your or third parties’ participation in any of the Games and shall not use any software-assisted methods or techniques or hardware devices for Your participation in any of the Games. BadBit.Games hereby reserves the right to ban any Ethereum addresses and take appropriate legal action in the event of such behaviour;

(H) You understand that the value of Ether, as well as the value of any cryptocurrencies, can change dramatically within a very short period of time depending on the market value and conditions.

4.2 Games played on BadBit.Games should be played in the same manner as games played in any other setting. This means that players should be courteous to each other and avoid rude or obscene comments. In particular, Players are reminded that they are responsible for conducting themselves in a friendly and courteous manner when using the chat box feature on the Website. All Players are responsible for ensuring they follow these rules when using the chat box feature:

(A) No Trolling. Do not make random, unsolicited and/or controversial comments with the intent or result of baiting or provoking unsuspecting fellow Players to engage in hostile arguments.

(B) No Spam. Do not promote other competing projects. Do not send large amounts of unsolicited messages unrelated to BadBit.Games. Do not send referral links, URL  shorteners, advertisements or other commercial offerings.

(C) Do not attempt to create a negative discourse on BadBit.Games using unfounded, baseless claims. Do not spread FUD (fear, uncertainty, doubt).

(D) No Begging. Do not post your cryptocurrency addresses on the chat box. Do not ask  other Players to send you cryptocurrency.

(E) Do not incite or engage in illegal activities. No malware, spyware, phishing or pharming links.

(F) Do not reveal any personally identifying information (PII), of Yourself or of any  other individuals.

(G) No personal attacks. No abusive language. Do not engage in conversations or send messages that contain discrimination based on gender, race, religion, ethnicity, nationality, or political inclination.

4.3 Failure to observe the chat box etiquette described in provision 4.2 above will result in an immediate ban from using the chat box with no warning. Serious offences will result in ban from the Website for both the Ethereum and/or Loom Network address and the IP address of the offending Player with no warning.

4.4 Should a Player become aware of possible errors or incompleteness in the software, he/she agrees to refrain from taking advantage of them. Moreover, the user agrees to report any error or incompleteness immediately to BadBit.Games. Should the user fail to fulfil the obligations stated in this clause, BadBit.Games has a right to full compensation for all costs related to the error or incompleteness, including any costs incurred in association with the respective error/incompleteness and the failed notification by the user.

4.5 BadBit.Games reserves the right to reject or limit wagers. The maximum bet sizes and pay out applicable at any time are liable to change without advance notice.

Part 5 – PRIVACY POLICY

5.1 You hereby acknowledge and accept that it might be necessary for BadBit.Games to collect and otherwise use Your personal data in order to allow You access and use of the Website and participation in the Games.

5.2 BadBit.Games hereby acknowledges that in collecting Your personal details as stated in the previous provision, We are bound by the Data Protection legislation – Law for protection of people with regards to the use of their personal data, law number 8968. BadBit.Games will protect your personal information and respect your privacy in accordance with best business practices and applicable laws.

5.3 BadBit.Games will only use Your personal data to allow You to participate in the Games and to carry out operations relevant to Your participation in the Games. All members of the staff shall have access to Your personal data for the purpose of performing their duties.

5.4 Your personal data will not be disclosed to third parties, unless such disclosure is necessary for processing of your requests in relation to Your participation in the Games. You hereby consent to such disclosures.

5.5 As an individual You may exercise Your right to access the data held about You by BadBit.Games by submitting Your request in writing. Although all reasonable efforts will be made to keep your information updated, you are kindly requested to inform us of any change referring to the personal data held by BadBit.Games. In any case if You consider that certain information about You is inaccurate, You may request rectification of such data. You also have the right to request the blocking or erasure of data which has been processed unlawfully.

5.6 In order to make Your visit to the Website more user-friendly, to keep track of visits to the Website and to improve the service, there is a possibility that BadBit.Games might collect a small piece of information sent from Your browser, called a cookie. You can, if you wish, turn off the collection of cookies (please refer to your browser instructions as to how to do this). You must note, however, that turning off cookies might restrict Your use of the Website.

5.7 If, while playing at BadBit.Games, You win a sum regarded by BadBit.Games Management as worthy of publicity, You agree to make Yourself available for any event of such nature arranged by BadBit.Games. While BadBit.Games protects all personal data entrusted to us, we reserve the right to use first names and the first initial of the last name in any BadBit.Games announcement about promotion results or on the Website.

5.8 We may also ask your permission to contact You, for the purpose of informing You of changes, new services and promotions We think that You may find interesting. If You do not wish to receive direct marketing data there will be an option for You to opt out of this service.

Part 6 – COMPLAINTS

6.1 You may contact our customer service according to the instructions located on the Website to give us any complaints regarding our services.

6.2 Complaints are handled in the support department and escalated in the organisation of BadBit.Games in the case that support personnel do not solve the case immediately or satisfactorily. The player shall be informed about the state of the complaint to a reasonable level.

6.3 In the event of any dispute, you agree that the records of the Ethereum and Loom Network public blockchains shall act as the final authority in determining the outcome of any claim. In the event of a complaint whose nature does not lend itself to resolution by reference to data on the Ethereum and Loom Network blockchains, the Player agrees that data on the BadBit.Games server shall act as the final authority in determining the outcome of such claims.

6.4 You agree that in the unlikely event of a disagreement between the result that appears on your screen and the Ethereum and/or Loom Network blockchains, the result that appears on the Ethereum and/or Loom Network blockchains will prevail, and you acknowledge and agree that records on the Ethereum and/or Loom Network blockchains will be the final authority in determining the terms and circumstances of your participation in the relevant online gaming activity and the results of this participation.

6.5 When we wish to contact You regarding such a dispute, we will do so by using any of Your Contact Details.

Part 7 – LIMITATION OF LIABILITY

7.1 You enter the Website and participate in the Games at Your own risk. The Website and the Games are provided without any warranty whatsoever, whether express or implied.

7.2 Without prejudice to the generality of the preceding provision, BadBit.Games, its directors, employees, partners, service providers:

(A) do not warrant that the software or the Website is/are fit for their purpose;

(B) do not warrant that the software and Website are free from errors;

(C) do not warrant that the Website and/or Games will be accessible without interruptions;

(D) shall not be liable for any loss, costs, expenses or damages, whether direct, indirect, special, consequential, incidental or otherwise, arising in relation to Your use of the Website or Your participation in the Games.

7.3 You hereby agree to fully indemnify and hold harmless BadBit.Games, its directors, employees, partners, and service providers for any cost, expense, loss, damages, claims and liabilities howsoever caused that may arise in relation to Your use of the Website or participation in the Games.

7.4 Nothing published by or on behalf of BadBit.Games constitutes solicitation or recommendation to enter into any security or investment. Neither content nor data published by BadBit.Games should be relied upon for investment, trading, or security purposes. Links to other sites do not constitute endorsement and should not be deemed as such, nor should such links be considered approval by BadBit.Games of the linked site, its owner, or its content. It is strongly advised that anyone perform independent research prior to making financial or investment decisions, along with seeking the advice of a qualified professional.

Part 8 – BREACHES, PENALTIES AND TERMINATION

8.1 If You breach any provision of these ToS or BadBit.Games has a reasonable ground to suspect that You have breached them, BadBit.Games reserves the right to ban Your Ethereum address and/or Loom Network address and/or IP address from further participation on the Website, and to take appropriate legal action.

8.2 You acknowledge that BadBit.Games shall be the final decision-maker of whether You have violated BadBit.Games’ rules, terms of service or conditions in a manner that results in Your suspension or permanent barring from participation in our site.

Part 9 – INTELLECTUAL PROPERTY RIGHTS

9.1 All website design, text, graphics, music, sound, photographs, video, the selection and arrangement thereof, software compilations, underlying source code, software and all other material contained within the Website are subject to copyright and other proprietary rights which are either owned by us or used under licence from third party rights owners. To the extent that any material contained on the Website may be downloaded or printed then such material may be downloaded to a single personal computer only and hard copy portions may be printed solely for Your own personal and non-commercial use.

9.2 Under no circumstances shall the use of the Website grant to any user any interest in any intellectual property rights (for example copyright, know-how or trademarks) owned by us or by any third party whatsoever.

9.3 No rights whatsoever are granted to use or reproduce any trade names, trademarks or logos which appear on the Website except as specifically permitted in accordance with the Terms of Use.

Part 10 – SEVERABILITY

10.1 If any provision of these ToS is held to be illegal or unenforceable, such provision shall be severed from these ToS and all other provisions shall remain in force unaffected by such severance.

Part 11 – ASSIGNMENT

11.1 BadBit.Games reserves the right to assign or otherwise lawfully transfer this Agreement. You shall not assign or otherwise transfer this Agreement.

Part 12 – APPLICABLE LAW AND JURISDICTION

12.1 The Terms of Service stipulated in this document are effective as of 14 July 2019. Before using the Website BadBit.Games, please read these Terms of Service carefully. The fact of using the Website confirms Your consent with the Terms of Service.

12.3 In case of dispute, the relevant laws and regulations of Costa Rica shall apply.
